The Compliance Principle
The discrimination must be for ‘requirements’ applied ‘so as to comply with the doctrines of the religion’. Note the inconsistency. It does not apply to race, as racist
(but not sexist or homophobic) religious doctrines are considered unacceptable (see above, JFS [2009] UKSC 15, [150]).
The Non-conflict Principle
“so as to avoid conflicting with the strongly-held religious convictions of a significant number of the religion’s followers” (the “non-conflict principle”).
